Here's the important legal protection most timeshare buyers don't know about: every US state with timeshare law has a mandatory rescission period. You have 3-10 business days to cancel a timeshare purchase with no penalty. This is federally and state-mandated.
State Rescission Periods
- Florida: 10 calendar days
- Nevada: 5 calendar days
- Tennessee: 10 calendar days
- South Carolina: 5 calendar days
- Hawaii: 7 calendar days
- California: 7 calendar days
- Virginia: 7 calendar days
- Missouri: 5 business days
States without specific timeshare law: Alaska, Arkansas, Delaware, DC, Kansas, Kentucky, Maine, Montana, New Hampshire, North Dakota, South Dakota, Vermont, Wisconsin, Wyoming, and a few others. In these states, contracts may have voluntary cancellation clauses.
How to Cancel
- Write a cancellation letter — must be postmarked within the rescission window. Date, your name and address, property description, statement: "I elect to rescind this contract under [state law]."
- Mail it certified + return receipt requested — via USPS Priority Mail with certified tracking. This is proof of delivery date.
- Cancel any credit card charges — contact your card issuer immediately to dispute the deposit charge if outside rescission window.
- Follow up in writing only — keep all correspondence written. Avoid phone calls.
What Happens After
Within 30-45 days of receiving your letter, the resort must refund your full deposit and any payments made. They legally cannot charge cancellation fees.
Common Mistakes
- Calling instead of writing — phone calls don't legally rescind. Must be written.
- Missing the deadline — one day over = no rescission right. Be fast.
- Delivering to wrong address — check the contract for the exact rescission address (may differ from general resort address).
- Waiting for refund before re-disputing the charge — the refund often doesn't happen automatically; you may need to dispute via your credit card.
Prevention
Don't sign. The vacpack is not the same as the timeshare contract. If your at the preview pitch, decline politely and leave. Never sign a contract at the sales table — at minimum, take it home to review.
